1. Acceptance of Terms

By using Zippy's services, you agree to these Terms and Conditions. Please read them carefully before booking any services.

2. Recurring Services

2.1 Service Scheduling

When you select a recurring service (weekly, bi-weekly, or monthly), you authorize Zippy to automatically schedule and perform the selected service at the chosen frequency.

2.2 Recurring Payment Authorization

By checking the "Recurring Payment Authorization" checkbox during booking, you authorize Zippy to:

  • Securely save your payment information
  • Automatically charge your selected payment method for each scheduled recurring service
  • Process payment on Monday of each week for services performed that week

2.3 Pricing for Recurring Services

Variable Pricing: The cost of recurring services may vary from visit to visit based on changes to your property, service scope, or other factors. Examples include:

  • Changes in property size or layout
  • Seasonal variations (e.g., grass height for lawn services)
  • Additional cleaning requirements
  • Changes in service add-ons or scope

Important: Any price increase or decrease exceeding $10 from your original quoted price will require our prior approval via email before the service is performed. You will have the opportunity to approve, modify, or cancel the service if the pricing changes significantly.

Rate Guarantee Period: Your recurring service rate is guaranteed for 3 months from your enrollment date or the date of any rate change. Zippy reserves the right to adjust recurring service rates to reflect market conditions, with 30 days advance notice via email. If you do not wish to continue at the new rate, you may cancel your recurring service through the customer portal at any time before the new rate takes effect.

2.4 Modification and Cancellation

You may modify or cancel your recurring services at any time through your customer portal or by contacting Zippy support. Changes take effect for the next scheduled service.

2.5 Service Fee Discount

Recurring services receive a 5% discount on the Zippy Service Fee as a benefit for your ongoing commitment.

3. Payment Terms

3.1 Payment Processing

All payments are processed securely through Stripe. Zippy does not store your complete credit card information.

Payment Security Details (For Legal Review)

Third-Party Payment Processor: Zippy uses Stripe, Inc. as our exclusive payment processor. Stripe is a PCI DSS Level 1 certified payment processor, the highest level of security certification in the payments industry.

Data Storage and Transmission: When customers enter payment information:

  • Payment card data is transmitted directly to Stripe's servers using TLS encryption
  • Card data never touches or is stored on Zippy's servers
  • Zippy receives only a tokenized payment method ID (e.g., "pm_1234567890") from Stripe
  • This token is stored in Zippy's database and used to reference the payment method for future charges

Recurring Payments: For recurring services, customers authorize future charges through Stripe's Setup Intent API. This authorization:

  • Allows Zippy to charge the stored payment method for future recurring services
  • Is stored and managed entirely by Stripe
  • Can be revoked by the customer at any time through their customer portal

Compliance and Liability: By using Stripe as the payment processor, Zippy's PCI DSS compliance obligations are significantly reduced as we do not handle, process, or store sensitive cardholder data. Stripe maintains compliance with PCI DSS, SOC 1 Type 2, SOC 2 Type 2, and ISO 27001 standards.

3.2 Service Fees

Zippy charges a service fee in addition to the professional's base rate. This fee covers platform costs, customer support, insurance, and payment processing.

3.3 Taxes

Applicable sales tax (8.25% in Texas) will be added to all services as required by law.

3.4 Quote Validity

Quotes generated through our platform are valid for 48 hours from the time of generation. After this period, pricing may change based on current rates, and you may need to request a new quote. This applies to one-time service bookings; recurring service pricing is subject to the Rate Guarantee Period described in Section 2.3.

4. SMS/Text Message Communications

4.1 Opt-In Requirement

SMS/text message notifications are completely optional. You must explicitly opt in through your account settings and verify your phone number before receiving any text messages from Zippy.

By opting in to SMS notifications, you consent to receive transactional text messages related to your services at the phone number you provide.

4.2 Message Types

If you opt in, you may receive the following types of text messages:

  • Service booking confirmations
  • Professional arrival notifications and ETA updates
  • Service completion confirmations
  • Payment reminders for recurring services
  • Time-sensitive updates about your scheduled services

4.3 Message Frequency

Message frequency varies based on your service bookings and activity. You will only receive messages related to services you have booked or are actively using.

4.4 Message and Data Rates

Message and data rates may apply based on your mobile carrier's plan. Zippy is not responsible for any charges you may incur from your mobile carrier for receiving text messages.

4.5 Opt-Out/Unsubscribe

You can opt out of SMS notifications at any time by:

  • Replying STOP to any text message from Zippy
  • Disabling SMS notifications in your account settings
  • Contacting customer support at info@zippydoes.com

Note: Opting out of SMS notifications will not affect your ability to use Zippy's services. You will still receive important communications via email.

4.6 Help and Support

For help with SMS notifications, you can:

  • Reply HELP to any text message from Zippy
  • Contact customer support at info@zippydoes.com
  • Manage your notification preferences in your account settings

4.7 SMS Service Provider

Zippy uses Twilio for SMS delivery. By opting in to SMS notifications, you acknowledge that your phone number will be shared with Twilio for the purpose of delivering text messages. Twilio's privacy policy can be found at twilio.com/legal/privacy.

5. Service Delivery

4.1 Property Access

You are responsible for providing accurate property access instructions. Zippy is not responsible for delays caused by incorrect or incomplete access information.

4.2 Service Quality

Zippy strives to provide high-quality services through our network of professionals. If you are not satisfied with a service, please contact us within 24 hours for resolution.

4.3 Weather and Unforeseen Circumstances

Services may be rescheduled due to severe weather or other unforeseen circumstances. You will be notified as soon as possible of any changes.

6. Platform Nature and Independent Contractors

5.1 Zippy as a Technology Platform

Zippy Services LLC ("Zippy") is a technology platform that connects customers with independent service professionals. Zippy does not directly employ service professionals, nor does Zippy directly provide home services.

Our role is to:

  • Provide a digital marketplace for customers to request services
  • Connect customers with qualified independent service professionals
  • Facilitate payments and scheduling
  • Provide customer support and dispute resolution assistance

5.2 Independent Contractor Relationship

All service professionals who provide services through the Zippy platform are independent contractors, not employees, agents, or representatives of Zippy.

This means:

  • Service professionals operate their own independent businesses
  • Service professionals are responsible for their own work, equipment, and methods
  • Service professionals determine how and when they perform services
  • Service professionals are responsible for complying with all applicable laws and regulations
  • Zippy does not supervise, direct, or control how service professionals perform their work

5.3 Limitation of Liability

ZIPPY IS NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES, OR NEGLIGENCE OF ANY SERVICE PROFESSIONAL.

By using our platform, you acknowledge and agree that:

  • Zippy does not guarantee the quality, safety, or legality of services provided by independent professionals
  • Zippy is not responsible for property damage, personal injury, or loss caused by service professionals
  • Service professionals are solely responsible for the work they perform, the quality of that work, and any consequences of that work
  • Any disputes regarding service quality, damages, or injuries must be resolved directly with the service professional

5.4 Dispute Resolution Assistance

While Zippy is not liable for service professionals' work, we are committed to helping resolve disputes:

  • We will facilitate communication between you and the service professional
  • We may assist in arranging corrective work or refunds (see our Refund Policy)
  • We will investigate quality complaints and may remove professionals who consistently provide poor service
  • We provide a customer support team to help address concerns

However, this assistance does not create liability on Zippy's part for the professional's actions or work.

5.5 Your Responsibility

As a customer using the Zippy platform, you acknowledge that:

  • You are hiring an independent service professional, not Zippy
  • You should communicate clearly with the professional about your expectations
  • You should inspect work upon completion and report issues promptly
  • You understand that Zippy is a platform facilitating the connection, not the service provider

5.6 Maximum Liability

To the fullest extent permitted by law, Zippy's total liability to you for any claims arising from your use of the platform or services booked through the platform shall not exceed the amount you paid to Zippy for the specific service giving rise to the claim.

IN NO EVENT SHALL ZIPPY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL.

7. Service Area and Availability

6.1 Geographic Limitations

Zippy currently operates exclusively in Collin County and Denton County, Texas, with a primary focus on Frisco, TX and surrounding communities.

We reserve the right to:

  • Decline service requests outside our designated service area
  • Expand or reduce our service area at any time without prior notice
  • Limit service availability based on professional availability in your area

6.2 Service Availability

While we strive to provide reliable service, we do not guarantee that services will be available at all times or in all areas within our service region. Service availability depends on the availability of independent professionals in your area.

8. Intellectual Property and User Content

7.1 Zippy's Intellectual Property

The Zippy platform, including our website, mobile applications, logos, branding, software, AI technology, and all related intellectual property, are owned by Zippy Services LLC and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our platform or technology without our express written permission.

7.2 User-Submitted Content and Photos

When you use our Services, you may upload or submit content including:

  • Property photos and images
  • Service descriptions and special instructions
  • Reviews, ratings, and feedback
  • Communications with service professionals

License Grant:

By submitting content to Zippy, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display your content for the following purposes:

  • Property Analysis: Using photos and property information to generate accurate service quotes via our AI technology
  • Service Delivery: Sharing necessary information with assigned service professionals
  • Platform Operations: Displaying reviews, ratings, and service history on our platform
  • Improvements: Improving our AI algorithms and service quality (using anonymized/aggregated data)
  • Marketing: Using anonymized examples of services for marketing purposes (we will not use identifiable photos without your permission)

7.3 Ownership of Your Content

You retain ownership of any content you submit. The license you grant us does not transfer ownership - it simply allows us to use the content to operate and improve our platform.

You can request deletion of your content by contacting us, though we may retain certain information as required by law or for legitimate business purposes.

7.4 Content Responsibility

You represent that any content you submit does not violate any laws or third-party rights. You are solely responsible for the content you provide and any consequences of sharing that content.

9. Account Termination and Suspension

8.1 Your Right to Terminate

You may close your Zippy account at any time by contacting us at info@zippydoes.com. Upon account closure, you will no longer have access to your service history, though we may retain certain information as required by law.

8.2 Zippy's Right to Terminate or Suspend

We reserve the right to suspend or terminate your account, refuse service, or cancel bookings at any time, for any reason, including but not limited to:

  • Violation of these Terms: Including abuse of our platform, professionals, or other users
  • Fraudulent Activity: Suspected fraud, chargebacks, or payment disputes
  • Abusive Behavior: Harassment, threats, or inappropriate conduct toward professionals or staff
  • Repeated Cancellations: Excessive cancellations that harm service professionals
  • False Information: Providing false or misleading information
  • Legal Requirements: Compliance with legal obligations or law enforcement requests
  • Platform Integrity: Any conduct that threatens the security or integrity of our platform

8.3 Effect of Termination

Upon termination or suspension:

  • You will lose access to your account and platform features
  • Any pending service requests will be canceled
  • Outstanding payments must still be paid
  • Refunds will be handled according to our Refund Policy
  • We may retain your information as required by law

8.4 No Liability for Termination

Zippy shall not be liable to you or any third party for any termination or suspension of your account or access to our Services.

10. Warranty Disclaimers

THE ZIPPY PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, Zippy disclaims all warranties, whether express, implied, or statutory, including but not limited to:

  • Implied Warranties of Merchantability: We do not warrant that our platform or services are suitable for any particular purpose
  • Implied Warranties of Fitness for a Particular Purpose: Services are provided as-is without guarantee of specific results
  • Non-Infringement: We do not warrant that use of our platform will not infringe third-party rights
  • Uninterrupted Service: We do not guarantee the platform will be available at all times or free from errors
  • Accuracy: We do not warrant the accuracy of AI-generated quotes, property analysis, or other platform features

Important Clarifications:

  • Zippy does not guarantee the quality, safety, or timeliness of services performed by independent professionals
  • Zippy does not warranty that professionals will complete work to your satisfaction
  • While we strive for accurate quotes, actual service needs may vary
  • Platform features, including AI analysis, are provided as tools and may contain errors

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, some of the above exclusions may not apply to you, and you may have additional rights under applicable law.

11. Dispute Resolution and Arbitration

10.1 Informal Dispute Resolution

Before filing any formal claim, you agree to contact us first to attempt to resolve the dispute informally:

  • Email us at info@zippydoes.com with a detailed description of the dispute
  • We will work with you in good faith to resolve the issue within 30 days
  • Most disputes can be resolved through direct communication

10.2 Binding Arbitration Agreement

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE ZIPPY PLATFORM SHALL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT.

Arbitration Process:

  • Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • The arbitration will take place in Collin County, Texas, or remotely via videoconference
  • The arbitrator's decision will be final and binding
  • Judgment on the arbitration award may be entered in any court having jurisdiction

Costs:

  • For claims under $10,000, Zippy will pay all AAA filing, administration, and arbitrator fees
  • For claims over $10,000, fees will be allocated according to AAA rules
  • Each party will pay their own attorney's fees unless the arbitrator awards them

10.3 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND ZIPPY INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW:

  • NO CLASS ACTIONS: You may not bring claims as a plaintiff or class member in any class or representative action
  • NO CONSOLIDATION: Claims may not be consolidated with claims of other customers
  • INDIVIDUAL BASIS ONLY: The arbitrator may not consolidate claims or conduct any form of class proceeding

10.4 Exceptions to Arbitration

Notwithstanding the above, either party may bring a claim in small claims court if it qualifies, or seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.

10.5 Opt-Out Right

You have the right to opt out of this arbitration agreement within 30 days of first using our Services by sending written notice to:

If you opt out, you retain the right to litigate disputes in court, but the class action waiver still applies.

10.6 Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any litigation not subject to arbitration shall be conducted exclusively in the state or federal courts located in Collin County, Texas.

12. Privacy and Data Protection

Your personal information and payment data are protected in accordance with our Privacy Policy. We use industry-standard encryption and security measures to safeguard your data.

13. Changes to Terms

Zippy reserves the right to update these Terms and Conditions at any time. Material changes will be communicated to customers via email. Continued use of our services after changes constitutes acceptance of the updated terms.
